SUTURE AMERICA RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT
Including But Not Limited To Interactive Educational Seminars, Workshops, and Events

This Release of Liability and Assumption of Risk Agreement (“Agreement”) is executed by the undersigned participant (“Participant”) in favor of Suture America, its officers, directors, employees, agents, volunteers, partners, affiliates, and any other associated individuals or entities (collectively referred to as “Suture America”).

WHEREAS, Suture America offers interactive educational seminars, workshops, and events designed to provide instruction and hands-on experiences in healthcare and medical practices; and

WHEREAS, the undersigned Participant desires to voluntarily participate in these educational activities, including but not limited to attending seminars, participating in workshops, and engaging in other related events (collectively referred to as the “Event”).

NOW, THEREFORE, in consideration of being allowed to participate in the Event, the undersigned Participant agrees as follows:

1. Assumption of Risk

The Participant acknowledges and agrees that participation in Suture America’s Event involves inherent risks, including but not limited to exposure to medical scenarios, physical and psychological stress, and the potential for injury. These risks may arise from interactions with other participants, use of equipment, or exposure to healthcare-related activities.

The Participant voluntarily assumes all risks associated with participation in the Event, including the risk of injury or harm, whether known or unknown, foreseen or unforeseen, and regardless of the cause.

2. Release of Liability

To the fullest extent permitted by law, the Participant hereby releases, waives, and holds harmless Suture America, its officers, directors, employees, agents, volunteers, partners, and affiliates from any and all claims, demands, actions, causes of action, damages, losses, liabilities, or expenses (including but not limited to attorney’s fees) that may arise out of or in connection with participation in the Event.

This release includes, without limitation, any claims related to personal injury, illness, physical or mental health issues, emotional distress, loss of property, or any other damage or harm suffered by the Participant during or as a result of attending or participating in the Event.

3. Indemnification

The Participant agrees to indemnify and hold harmless Suture America, its officers, directors, employees, agents, volunteers, partners, and affiliates from any and all claims, damages, losses, expenses, or liabilities, including attorney’s fees, arising from the Participant’s actions, omissions, or negligence during participation in the Event.

4. Medical Care and Health

The Participant understands and acknowledges that it is their sole responsibility to assess their own health and suitability for participation in the Event. The Participant agrees to seek appropriate medical advice or attention before participating in any of the activities if necessary.

Suture America is not responsible for providing any medical care or treatment during the Event, nor for any medical emergencies that may arise during or after participation in the Event.

5. Instructional Materials and Use

The Participant understands that all materials, including but not limited to presentations, videos, handouts, demonstrations, and any other content provided during the Event, are for instructional purposes only. These materials are intended to educate and inform, but they should not be construed as professional medical advice, diagnostic tools, or substitute for formal training.

The Participant agrees to use the materials solely for the purposes of education and acknowledges that any use of the materials outside the scope of this instruction, particularly in a clinical or professional context, is done at the Participant’s own risk.

6. Code of Conduct

The Participant agrees to act in a respectful, professional, and ethical manner at all times while attending and participating in the Event. The Participant agrees to adhere to all guidelines, rules, and regulations provided by Suture America. Suture America reserves the right to suspend or remove any Participant from the Event if the Participant engages in disruptive, dangerous, or inappropriate behavior.

7. Acknowledgment of Understanding

By signing this Agreement, the Participant acknowledges that they have read and fully understand the terms of this Release of Liability and Assumption of Risk Agreement. The Participant understands that by signing, they are waiving certain legal rights, including the right to sue Suture America for any injuries or damages that may occur during their participation in the Event.

The Participant further acknowledges that they have had the opportunity to ask questions and seek clarification on any aspect of this Agreement before signing.

8. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the state of Arizona, United States, without regard to its conflict of law principles. Any disputes arising out of or relating to this Agreement shall be resolved in the courts of Arizona.

9. Severability

If any provision of this Agreement is determined to be invalid, unenforceable, or illegal, the remaining provisions of this Agreement shall remain in full force and effect.

10. Entire Agreement

This Agreement constitutes the entire understanding between the Participant and Suture America concerning the subject matter hereof, and supersedes any prior or contemporaneous agreements, representations, or understandings, whether oral or written.
